Constitutional-Legal Succession: Concept and Content
Annotation
The article deals with issues of succession in constitutional law, which is proposed to be designated as “constitutional-legal succession”. The peculiarities of such succession in constitutional law are determined by the subject and method of the industry, examples are given when the successor bears more obligations than the predecessor had, which is not typical for other branches of Russian law. Objects of succession are distinguished: public power (generic object); powers, rights, duties, constitutional values, legal institutions (species objects). Among the properties of constitutional and legal succession are noted: continuity; stability; evolution; historicity; identity (identity). Considered succession in a narrow sense as a legal process of transferring objects from one entity to another and a legal institution; broadly defined as a pattern of nation-building. A conclusion is made about constitutional and legal succession as a way of transferring and preserving the objects of constitutional law, guaranteeing the continuity of state building.
