Features of the Concept of "Group of Persons Including a Foreign Investor"

The work is devoted to the central legal category of the legislation on foreign investments – “a group of persons, which includes a foreign investor”. Questions are raised about the relationship of this concept with the “group of persons”, defined within the framework of antimonopoly control. Based on the analysis of legal regulation and judicial practice, conclusions are formulated that these concepts do not fully coincide. When controlling foreign investments, an additional criterion is the “investment status” in relation to a strategic enterprise on the part of a person recognized as a foreign investor. In addition, the formal classification of persons as members of a group according to the characteristics of antimonopoly legislation is not absolutely necessary for identifying a group of persons with the participation of a foreign investor, since it is permissible to take into account the actually established relations between members of the group, acting in a single economic interest.
