On the Possibility of Establishing Criminal Liability for Artificial Intelligence in Vietnamese Laws

Annotation

The rapid development of artificial intelligence (AI) has posed new legal challenges, particularly regarding criminal liability when AI causes harm. This article analyzes the possibility of introduction of criminal liability for AI in the Vietnamese legal system. The study uses comparative and analytical methods to examine AI criminal liability models worldwide and their applicability in Vietnam. Results indicate that introduction of criminal liability for AI is both necessary and feasible, although it requires an appropriate roadmap suitable for Vietnamese legal conditions. The article proposes specific solutions to improve the legal framework for AI, including supplementing provisions in the Criminal Code and establishing mechanisms for determining legal liability of AI-related subjects.
