On Application of Simplified Procedures in Proceedings Before a Justice of the Peace
Annotation
The article analyzes the issues related to the simplification of proceedings before a justice of the peace. The author highlights the current trend of simplification of procedures at all levels of state courts, including proceedings before a justice of the peace. By analyzing the consideration and resolution of cases by a justice of the peace, the author concludes that elements of simplified proceedings are also applied at this level of the judicial system. The simplified form is manifested in the use of writ proceedings. In the article, the author concludes that simplification is characteristic not only of state courts but also of arbitration institutions. It is noted that certain procedures reflecting simplification before a justice of the peace are also features of simplified procedures in arbitration, and the paper offers a comparative analysis of the implementation of simplified procedure features by a justice of the peace and the application of simplified procedures in arbitration.
