Legal mechanism for the implementation of people's power: legal nature and structure
Annotation
This article examines a comprehensive state-legal mechanism for the implementation of the principle of democracy as the basis for the organization of public power in a modern state. Special attention is paid to the disclosure of the legal nature of this mechanism, reflecting the unity of the law and the people's will, as well as the structural diversity of instruments of popular participation in government. The author identifies the main elements of the mechanism, including the institutions of elections, referendums, participation in the judicial system, as well as forms of direct participation of the population in some publicly significant issues. The article analyzes the role of the people as the bearer of sovereignty in a federal state, considering the legal specifics of the constituent entity. The emphasis is placed on the dynamism of the mechanism and its dependence on historical and cultural factors, which determines the need for legal support for the real embodiment of popular power, and not just its declarative consolidation.
