Collective Distrust of Jurors: The Limits of Jury Dissolution in Criminal Proceedings
Annotation
The article examines the lawful composition of the court as a fundamental procedural guarantee of fair criminal justice. Special attention is paid to the specifics of forming a jury court and to the legal consequences of violations committed during the selection and participation of jurors. Particular emphasis is placed on distinguishing between such procedural concepts as juror recusal, juror removal, and dissolution of the jury panel. The article analyzes the legal positions of the Constitutional Court of the Russian Federation, including Ruling No. 2660-O of October 30, 2025, revealing issues related to an expansive interpretation of the grounds for dissolving a jury. The author concludes that individualized procedural measures should take precedence over collective dissolution of the jury in order to preserve legal certainty and the stability of judicial decisions.
