Substantial Violations Committed at the Stage of Preparing a Criminal Case for Court Hearing as a Ground for Quashing a Sentence
Annotation
The article proposes to consider the shortcomings in the court's activities at the stage of preparing a criminal case for a hearing. The errors made by the judge at the stage of preparing the case for the court session are classified. The judicial practice on identification of the considered errors and their correction is analyzed. The forms of correction of errors are established. It indicates a gap in the legislation regarding the regulation of the judge's self-correction of errors, as well as a way to fill it. Conclusions are drawn regarding the appeal and correction of mistakes made during the preparation stage.
