Some Issues of Identification of a Land Plot as a Crime Subject

The article discusses the issue of identifying a land plot as an object of a crime. It reveals the discussion on the possibility of stealing real estate, including land plots, by physically removing them. The article also distinguishes between environmental crimes committed on land plots and the theft of minerals through illegal subsoil use. The article concludes that a land plot as an object of a crime, which is a complex of relevant property rights, must be registered with the state cadastral office and have fixed boundaries on the ground. Only such a land plot as a property asset should be recognized as a real estate object and, accordingly, identified as the subject of a crime. The mechanism of theft of real estate objects through their physical seizure, as presented in judicial practice, cannot be applied to land plots due to the specific nature of this object of civil law.
