The Protection of Classified Information as an Element of Restricting and Violating Human and Civil Rights in the United States of America: The “State Secrets Privilege”

Annotation

The article analyzes the features of protecting information in the United States that contains state secrets. The author examines the levels of secrecy of state secrets and other categories of information that are restricted in the United States. It has been shown that, unlike the Russian judicial investigation (consideration of a case), the judicial investigation in the United States, which involves the examination of evidence containing classified information, places the interests of the state in protecting national security above the rights of individuals and citizens enshrined in the U.S. Constitution, as U.S. law has empowered the executive branch and especially the intelligence community to terminate any investigation (including judicial investigations) if it could lead to the disclosure of such information related to the case. Additionally, U.S. government representatives have the authority to refuse to present evidence in court if it contains classified information that could be disclosed.
