Prosecutorial Supervision in the Sphere of Protecting the Civil Rights of Military Personnel of the Armed Forces of the Russian Federation
Annotation
The article critically evaluates the current version of Art. 45 of the Civil Procedure Code of the Russian Federation in the part where it establishes the grounds for the prosecutor to appeal to the court in defense of violated or disputed civil rights or legitimate interests of citizens. It is shown that the presence or absence of these grounds is determined by the court, which in some cases is guided only by its own discretion. Based on the legal positions of the Constitutional Court of the Russian Federation, the author comes to the conclusion about the special substantive and procedural status of servicemen of the Armed Forces of the Russian Federation, the most important feature of which is increased guarantees of protection from the state. It is proposed to consider prosecutorial supervision in the sphere of civil jurisdiction as one of such guarantees, which is why it is necessary to supplement Article 45 of the Civil Procedure Code of the Russian Federation with an indication of the prosecutor's right to apply to the court to protect the rights and interests of military personnel, due to their special status and regulated by the norms of special laws. It is also proposed to necessarily involve the prosecutor in the consideration of civil cases on the protection of the rights and interests of military personnel in order to give an opinion on it.
