Apologia of "Criminal Law in a Broad Sense": The Conflict-of-Laws and Jurisdictional Aspect
Annotation
The purpose of the article is solution of the problem of limited jurisdiction of Russia in administrative offenses committed abroad. Restrictive interpretation of the territorial principle in the Administrative Offense Code of the Russian Federation deprives the state of law enforcement instruments. The solution is to accept the concept of "criminal law in a broad sense" by application of criminal procedure approaches to the provisions of the Administrative Offense Code. This will allow establishment of jurisdiction based on "closed" extra-territorial principles (objective territoriality) and create the opportunity to improve jurisdictional provisions in the Administrative Offense Code to ensure the constitutional right to judicial protection and spatial expansion of the law enforcement function of the state.
