The Institution of Reopening Cases Due to New or Newly Discovered Circumstances in the Romano-Germanic Legal Family: A Comparative Analysis of Civil Procedural Legislation

Annotation

The article presents a comparative legal analysis of the institution of reviewing civil cases based on new and newly discovered circumstances in countries of the Romano-Germanic legal family, specifically Russia, France, Germany, Hungary, and Estonia. The study identifies both similarities and distinctive features in the approaches of these legal systems to the review of court decisions. It also reveals common trends in the development of continental civil procedural law regarding the reconsideration of judicial acts based on new or newly discovered circumstances. Based on the findings, the authors conclude that it is necessary to improve the current civil procedural legislation in the examined legal systems, considering the identified trends in the evolution of this legal institution within civil procedure.
