On the Discussion about the Concept of International Administrative Law and Its Development Stages
Annotation
The article is devoted to the analysis of the concept and history of the formation of international administrative law as a normative and procedural element of the international legal order. In the context of the transformation of public international law and the strengthening of the managerial functions of international organizations, the author substantiates the allocation of international administrative law governing the activities of international administration in the exercise of international public authority. The article reveals the content of the category «international administration» as a set of bodies and procedures through which managerial powers are exercised at the supranational level, and identifies administrative standards comparable to the institutions of national administrative law. The theoretical reasoning is based on the theory developed by A.B. Zelentsov's concept of the subject of administrative law, according to which administrative procedures and procedural guarantees are a key element of modern administrative and legal regulation, ensuring the restriction of public authority and the protection of the rights of addressees of managerial decisions. The article proposes a three - stage periodization of the historical development of international administrative law — from international administrative unions and technical regulation to the institutionalization of the internal law of international organizations and the modern proceduralization of international public authority. Special attention is paid to the relationship between international administrative law and the Global administrative law concept, based on the «private — general» model. The conclusion is drawn about the importance of international administrative law for national legal systems, including Russian administrative law, primarily in terms of sources and procedural guarantees.
