On Improving Judicial Practice in Considering Criminal Cases on Unlawful Impact on the Critical Information Infrastructure of the Russian Federation (Art. 274.1 of the Criminal Code of the Russian Federation)
Annotation
Currently, modern cybercrime is one of the systemic threats to the Russian state and society. At the same time, crimes that encroach on the critical information infrastructure of the Russian Federation pose the greatest danger. Based on the analysis of judicial acts: convictions and decisions on termination of criminal prosecution, the author identifies typical errors in the qualification of the above-mentioned criminal acts committed by judges when considering criminal cases of unlawful influence on the critical information infrastructure of the Russian Federation. The article contains the author's conclusions and proposals aimed at improving and ensuring the uniformity of judicial practice in terms of the qualification of acts provided for in Article 274.1 of the Criminal Code of the Russian Federation.
