An Attorney Representative in Cases Arising from Family Legal Relations

This article examines the key aspects of a lawyer's participation as a representative in cases arising from family legal relations. The relevance of this study is due to the increasing need for qualified legal assistance in resolving family disputes that affect a wide range of rights and legitimate interests of citizens. The article analyzes the legal basis for a lawyer's representation in family cases, including the provisions of the Family Code of the Russian Federation, the Civil Procedure Code of the Russian Federation, and the Federal Law “On Legal Practice and the Bar in the Russian Federation”. Special attention is given to the issues of defining a lawyer's authority, drafting a power of attorney, and maintaining attorney-client confidentiality. The article explores the features of a lawyer's involvement in various categories of family disputes, such as divorce cases, property division, child custody, alimony collection, and paternity establishment. It examines the tactics and strategies employed by lawyers to protect their clients' interests in court. The article emphasizes the importance of a lawyer's adherence to ethical standards and principles of professional conduct when representing clients in family matters. It highlights the need for lawyers to demonstrate sensitivity and respect for the interests of all parties involved, especially when minors are involved in the dispute. Based on the analysis of judicial practice and doctrinal sources, proposals are formulated to improve legislation and the practice of applying family law norms, aimed at increasing the effectiveness of protecting the rights and legitimate interests of citizens in family disputes.
