Private Law Instruments for Regulating Labor in the Context of Intellectual Production Automation

Annotation

The combination of private and public law principles in the regulation of hired labor, which is characteristic of labor law, is an important feature of the method of labor law regulation. The spread of artificial intelligence in the labor sphere changes the balance of power between the parties to labor relations. An employer using artificial intelligence acquires new opportunities, as a result, the likelihood of changing labor legislation in the direction of strengthening public law foundations increases, which creates a threat to the existence of labor law as a social phenomenon that combines the regulation of relations based on the legal equality of the parties with additional protection of the "weak" party. The article contains proposals for strengthening the private law component of the labor law branch.
