The Use of Human Dignity as a Legal Value in the Argumentation of the Constitutional Court of the Russian Federation: Practical Meaning and Unintentional Wordplay
Annotation
This article deals with the analysis of the practice of Russian Constitutional Court in the field of usage of the human dignity as a part of its argumentation. In the introduction the author reminds that the conception of human dignity is very complex, and it means that giving the definition of this category and identifying its substance is a very hard task. But these circumstances don’t construct an obstacle to the Russian Constitutional Court which doesn’t hesitate to use the category of human dignity as an element of its argumentation in different cases. In the main part several examples of Constitutional Court’s judgments are demonstrated and analyzed. It’s shown that the body of constitutional control uses the human dignity quite often and as a root of different social-economic rights and different financial payments and benefits, including compensation of moral damage. At the same time the Court underlines the significance of the human dignity as basic constitutional value. In conclusion the idea on pragmatic approach of Constitutional Court is provided – even if the definition and substance of human dignity is not identified yet, this fact shouldn’t be an obstruction for using this concept as rather effective tool of legal argumentation for constitutional protection of human rights.
