The Application of Cyber-Physical Systems in Providing Treatment and Rehabilitation Services: Civil Law Aspects
Annotation
This article is devoted to the study of the main trends in the use of cyber-physical systems (CPS) in the provision of treatment and rehabilitation services from the standpoint of determining the prospects for the development of civil legislation in this area. It is substantiated that the desire for autonomy of CPS provokes the emergence of a number of risks, including the risk of depriving the user of the opportunity to act at his own discretion in matters of consent to certain types of treatment and specific medical manipulations, the implementation of his status as a subject of family relations and economic activity. Overcoming this situation can be associated with the recognition of intelligent CPS as a new type of subjects of civil law. The conditions for such recognition are: endowment with the characteristic of property isolation, definition of algorithms for recognizing the legal will of such subjects. This approach allows us to formulate requirements for the content and quality of services provided by CPS, as well as legal mechanisms for ensuring control over their safety.
