Modern russian penal legislation applies the terms “regime of serving a sentence” and “conditions of detention” to the specifics of serving a sentence. At the same time, there is some confusion between them, which cannot be recognized as positive due to the possibility of toughening the procedure for serving imprisonment without the administration of the correctional institution going to courthe regime is a set of conditions in which a person is kept when serving a sentence related to imprisonment. It was concluded that it is advisable to consolidate in the Penal Code of the Russian Federation only the usual conditions of detention corresponding to a specific regime of detention, and facilitated (improved) conditions used as a measure to encourage positively proven convicts, as it was established in the Correctional Labor Code of the RSFSR.
