Issues of the Concept of Digital Constitutionalism as an Ideology Determining Legal Behavior in the Virtual Environment
Annotation
The article examines some issues of the concept of digital constitutionalism as an ideology determining legal behavior in a virtual environment. It is shown that the widespread use of digital technologies in public and private life has an increasing impact on Russian society and seriously affects the constitutional rights and freedoms of citizens. This is substantiated, in particular, by the fact that digital technologies are often used without the necessary scientific justification, without preliminary research into what threats and risks they will pose to constitutional human rights and freedoms and without developing an effective mechanism for their protection. It is articulated that there is still no legal regulation adequate to the challenges of the digital revolution, and the responses to them from public authorities are a semblance of moral and ethical wishes or principles. In order to establish an effective process of constitutionalization of digital law, in the set of tools, along with the stenographic material of constitutional and legal norms, universal provisions are also proposed, i.e. acceptable for the entire virtual world, proposed by the private sector, promoting its AI systems to the market.
