Third Parties in Disputes over Recognition of Relations as Employment Ones

The article is dedicated to an analysis of the role of third parties in disputes over recognition of relations as employment ones. In recent years, the legal status of employees of the shadow labor sector working without an official employment agreement has become a relevant litigation issue. Third parties may play a significant role in such disputes. The article studies two categories of third parties (those who assert independent claims regarding the subject matter of the dispute, and those who do not). The paper analyzes the role of third parties in protecting their interests, and the impact of their involvement on the outcome of the case. The author concludes that the involvement of third parties in such disputes contributes to a more complete and objective consideration of cases and enhances the level of protection of employees' rights. Proposals are made to improve the laws in this sphere. In particular, an attempt is made to word a definition of the "third party" concept.
