This article examines the problems of determining the jurisdiction of divorce cases in connection with resolving the issue of the fate of the spouses' common minor children in accordance with Article 24 of the Family Code of the Russian Federation. Based on the analysis of scientific literature, legislation, and judicial practice, the criteria for the jurisdiction of this category of cases are shown, the content of the concept of "dispute about children" is revealed, on which the decision on jurisdiction depends, and the problems arising from the application of art. 24 of the Family Code of the Russian Federation and art. 23 of the Civil Procedure Code of the Russian Federation are identified. In order to ensure uniformity of approaches in law enforcement activities in the field of the implementation of these provisions, respect for the rights and legitimate interests of minor children at the dissolution of marriage, the author proposed to amend the criteria for delineating the jurisdiction of the category of cases under consideration.
